Is crypto legal in Wyoming?
Yes. Owning and trading crypto is legal in Wyoming, and the state has gone further than any other: virtual currency has been exempt from money transmitter licensing since HB 19 in 2018, and the state charters banks built for digital assets. The one new licence is for crypto kiosks, required since 6 March 2026.
Wyoming’s rules sit in four pieces. HB 19 (2018) exempts virtual currency from the Money Transmitters Act, so an exchange does not need that licence in the state. The Division of Banking charters special purpose depository institutions (SPDIs), banks that take deposits and hold digital assets under the 2019 SPDI Act (HB 74), alongside a 2019 digital asset law (SF 125). SF 38 lets a Wyoming limited liability company declare itself a decentralized autonomous organization, effective 1 July 2021. And since March 2026, crypto kiosk operators must be licensed or chartered. The legislature’s own site refused our connection, so the 2018 and 2021 laws are read from its bill pages as relayed in search results; each is dated in the timeline below.
Wyoming also issues its own stablecoin. The Wyoming Stable Token Commission launched the Frontier Stable Token (FRNT) in August 2025 on seven blockchains, backed by dollars and short-term Treasury bills at 102 percent, according to Loeb & Loeb.
Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Wyomingites too. Both are covered in our United States guide.
Which crypto licences does Wyoming require?
None for an exchange. Wyoming exempts virtual currency from its money transmitter law, so exchanges need no state licence to serve residents. Kraken holds the state’s bank charter for crypto, and Gemini shows a Wyoming money transmitter licence (No. 7357).
Gemini’s Wyoming page says “Gemini is available in Wyoming”, lists licence 7357 and offers USD as the only fiat currency. Kraken operates Kraken Financial, which Hunton reports received an SPDI charter on 16 September 2020, the first of its kind. Kraken’s licensing page (30 September 2026) names it as a “Wyoming-chartered Special Purpose Depository Institution”.

Coinbase, OKX, Crypto.com, Bitstamp and Gate publish no Wyoming licence we could read, and Coinbase’s licence page refused our connection. With the 2018 exemption that is expected, not a red flag. The Division of Banking says on its SPDI page that the Banking Board “has approved four SPDI charters thus far”, but the page is dated 2021 and does not name them, so we do not count Wyoming’s SPDIs beyond Kraken Financial.
Best crypto platforms for Wyoming residents
By our access score inside Wyoming, Gemini (8.4 out of 10), Kraken (8.3) and Coinbase (7.9) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Wyoming resident can use each platform, not its fees or safety. It is the US score with Wyoming’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has a Wyoming-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit Wyoming residents?
None of the platforms we track. We found no tracked exchange, prediction market or DeFi protocol that names Wyoming as excluded or limited in its own terms, licence page or help centre, so Wyoming residents get the same product list as the rest of the US.
Two primary pages name Wyoming as served. The Crypto.com help centre (15 September 2025) lists it among the 49 states where its App is available, with only New York excluded, and Kraken’s US quick-start page (30 March 2026) lists Wyoming among its onchain staking states. Kraken excludes Maine and New York.
One page is ambiguous. OKX’s US licence page (updated 15 September 2026) lists 45 jurisdictions it serves, and Wyoming is not among them. The same page’s list of places it does not serve names only New York, American Samoa, Guam, the Northern Mariana Islands and the US Virgin Islands. We read that as unclear rather than as an exclusion, so the dataset keeps the US status for OKX; check with OKX before you rely on it.
Who regulates crypto in Wyoming?
The Division of Banking charters crypto banks and now licenses kiosks, the Legislature writes the rules, and the Stable Token Commission runs the state’s stablecoin. Federal courts have so far denied a Wyoming crypto bank, Custodia, a Federal Reserve master account.

- Division of Banking. It began taking SPDI applications on 1 October 2019 and approved Kraken Financial in September 2020. The Division’s SPDI page is dated 2021, so we cannot give a current count of charters.
- Legislature. HB 19 (2018) exempted virtual currency from money transmitter licensing; SF 38 created the DAO LLC on 1 July 2021. HB 75, signed by Governor Mark Gordon on 6 March 2026, requires kiosk operators to hold a money transmitter licence or be a state-chartered institution, lets the banking commissioner set kiosk rules and makes violations a felony with at least three years in prison and a $10,000 fine, ATM Marketplace reports (25 March 2026). The law took effect immediately.
- Stable Token Commission. It governs FRNT, which Loeb & Loeb reports launched in August 2025 on Ethereum, Solana, Arbitrum, Avalanche, Base, Optimism and Polygon.
- Courts. On 13 March 2026 the Tenth Circuit denied rehearing en banc, 7-3, in Custodia Bank’s suit over a Federal Reserve master account. Judge Timothy Tymkovich dissented, warning the panel handed Reserve banks a veto over states’ chartering power.
- Attorney General. We found no Wyoming Attorney General action against a crypto platform.
Are prediction markets legal in Wyoming?
Unsettled. We found no Wyoming action against Kalshi, Polymarket or any other event-contract platform, and no Wyoming bill on them. The state licenses online sports betting through its Gaming Commission, and that law does not mention prediction markets.
Governor Gordon signed Wyoming’s online sports wagering law, HB 133, on 5 April 2021, according to the Gaming Commission. Its page makes no mention of prediction markets or event contracts, and we found no cease-and-desist letter or lawsuit in Wyoming. That is a negative result, not a safe harbour: other states have acted against the same platforms. Those actions and the federal side are in our United States guide.
How is crypto taxed in Wyoming?
Wyoming charges no state tax on crypto gains because it has no individual income tax. The state sales tax is 4.00 percent, and we found no Wyoming guidance applying it to crypto purchases.
The Tax Foundation’s 2026 profile says Wyoming has no individual income tax and a 4.00 percent state sales tax, with an average combined state and local rate of 5.36 percent. Federal capital gains tax still applies; the rules are in our United States guide. The Department of Revenue site did not load for us, so confirm any sales or property tax question there.
