Is crypto legal in Mississippi?
Yes. Owning and trading crypto is legal in Mississippi, the state has no crypto-specific licence, and since 1 July 2026 every crypto kiosk operator must hold a money transmitter licence from the Department of Banking and Consumer Finance.
The Department licenses money transmitters under the Money Transmission Modernization Act, Miss. Code Ann. 75-16-1 and following. Its memo of 1 July 2026 says HB 1625, the Mississippi Virtual Currency Kiosk Consumer Protection Act, was signed on 8 April 2026 and requires every kiosk operator to be licensed under that Act. A second 2026 bill, HB 1596, revises the same Act.
We found no BitLicense-style regime and no approved coin list. Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Mississippians too. Both are covered in our United States guide.
Which crypto licences does Mississippi require?
None for crypto as such. A firm that moves customers’ money needs a money transmitter licence under the Money Transmission Modernization Act, and four of the seven US exchanges we track list a Mississippi licence on pages we could read: Gemini, Kraken, OKX US and Crypto.com.
Applications go through the Nationwide Multistate Licensing System. Kiosk operators already licensed had to report every kiosk location through the system by 17 August 2026, then within 45 days of each quarter end. New applicants answer a kiosk questionnaire that covers locations, authorized delegates and white-label providers.

Gemini prints licence 1518126, OKX lists 1767779 for token-to-token and USD-to-token services, and Kraken lists two, for Payward Interactive (1843762) and Payward Financial (2429615). Crypto.com names the Department on its US legal page, but the table is garbled and we record no number. We could not read licence pages for Coinbase (blocked), Bitstamp (empty) or Gate (no Mississippi entry), so we do not count them.
Best crypto platforms for Mississippi residents
By our access score inside Mississippi, Gemini (8.4 out of 10), Kraken (8.3) and Coinbase (7.9) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Mississippi resident can use each platform, not its fees or safety. It is the US score with Mississippi’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has a Mississippi-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit Mississippi residents?
None of the platforms we track. We found no exchange, prediction market or DeFi protocol that names Mississippi as excluded or limited in its own terms, licence page or help centre, so residents get the same product list as the rest of the US.
The exclusions we did read name other states. Crypto.com serves the App everywhere but New York and bars staking in New York, California, Maryland, New Jersey and Wisconsin. OKX excludes New York and the territories. Kraken names Mississippi among the states where onchain staking is open and bars only New York and Maine entirely.
Some pages would not load, so silence there is not evidence: Coinbase’s help centre and licence page returned errors, and so did Uniswap’s terms, Kalshi’s rulebook and Polymarket’s terms. We also could not confirm any Mississippi limit from third-party guides, which list other states as blocked for Polymarket.
Who regulates crypto in Mississippi?
The Department of Banking and Consumer Finance does most of it, through money transmitter licensing, including kiosk operators since 1 July 2026. The Attorney General has acted through multistate filings. We found no action against a platform by any Mississippi authority.

- Banking and Consumer Finance. HB 1625 was signed on 8 April 2026 and took effect on 1 July 2026. Licensed operators had to report kiosk locations by 17 August 2026.
- Attorney General. Baker McKenzie reported Mississippi among 18 states suing the SEC in November 2024. We could not read the complaint itself.
- Legislature. HB 1625 and HB 1596 are the 2026 laws. We found no enacted law on self-custody, mining or a state bitcoin reserve.
Federal oversight is in our United States guide.
Are prediction markets legal in Mississippi?
Mississippi has not acted against Kalshi, Polymarket or any other prediction market as of 20 October 2026, but its Attorney General told the CFTC on 4 May 2026 that sports event contracts belong under state authority.
- 4 May 2026: Attorney General Lynn Fitch joined 40 other attorneys general in a formal CFTC comment saying sports event contracts are indistinguishable from sports bets and that states should regulate them.
- 24 March 2026: Mississippi Public Broadcasting reported the Gaming Commission’s executive director, Jay McDaniel, telling lawmakers “it’s wagering, it’s gambling”, while taking a wait-and-see approach. We found no commission notice, so treat this as secondary.
Mississippi allows sports betting only in person at casinos, according to the same report. The wider fight is in our United States guide.
How is crypto taxed in Mississippi?
As ordinary income. Mississippi taxes nothing on the first $10,000 of taxable income and charged 4% above that for tax year 2026, down from 4.4% in 2025, with 3.75% scheduled for 2027.

The Department of Revenue’s rate page lists the 0% band, the three rates above and, for a single filer, a $2,300 standard deduction and a $6,000 exemption. Joint filers get $4,600 and $12,000, and each dependent, taxpayer aged 65 or over, or blind filer adds $1,500. Ernst & Young reports that HB 1 of 2025 continues the cuts to 3% by 2030.
We found no Department guidance page on crypto and no preferential capital gains rate. Federal capital gains rules are in our United States guide.
