Yes. Owning and trading crypto is legal in Nebraska, and the state has no BitLicense-style crypto licence. Money transmitters and crypto kiosk operators are licensed by the Department of Banking and Finance (NDBF), and the state charters digital asset banks.

Nebraska courts the industry. Governor Jim Pillen’s message to the industry, when NDBF chartered a digital asset bank in November 2025, was “Nebraska is open for your business”. Its Attorney General co-led an 18-state suit against the SEC over crypto enforcement in November 2024. No Nebraska law bans holding or trading crypto.

Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Nebraskans too. Both are covered in our United States guide.

Which crypto licences does Nebraska require?

No crypto-specific licence. A company that moves customers’ money needs a money transmitter licence from NDBF, and crypto kiosk operators have needed one since 3 September 2025. A separate charter covers digital asset depositories, which are a kind of crypto bank.

NDBF licenses money transmitters through the Nationwide Mortgage Licensing System and points the public to its money transmitters page for the licensee search. We found no NDBF guidance saying whether a plain coin exchange needs the licence, and we could not read a licensee list or count. Of the exchanges we track, Gemini’s Nebraska page names its Nebraska money transmitter licence (no. 1518126) from the Department. We could not confirm the licences of the others from state records.

The Nebraska Financial Innovation Act created a charter for digital asset depository institutions. Telcoin, Inc. of Norfolk applied under section 8-3015 of the Act, and NDBF scheduled a hearing for 5 December 2024. The Department chartered Telcoin Digital Asset Bank on 12 November 2025, which the state describes as a first in the country.

Best crypto platforms for Nebraska residents

By our access score inside Nebraska, Gemini (8.4 out of 10), Kraken (8.3) and Coinbase (7.9) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully a Nebraska resident can use each platform, not its fees or safety. It is the US score with Nebraska’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has a Nebraska-specific cut, so the scores track the US ones. Gemini ranks first because we hold its Nebraska licence number on file. The method is on our methodology page.

Which platforms block or limit Nebraska residents?

None of the platforms we track. We found no tracked exchange, prediction market or DeFi protocol that names Nebraska as excluded or limited in its own terms, licence page or help centre, so Nebraska residents get the same product list as the rest of the US.

The exclusions we did find name other states. Kraken serves every state except New York and Maine. Crypto.com bars staking in New York, California, Maryland, New Jersey and Wisconsin, and OKX excludes New York and the territories. Several platform pages were not readable when we checked, so a silent page is not proof: we re-check the rows when a platform publishes a state list.

Kiosks are rules on machines, not on platforms: Nebraskans can still buy and trade crypto online.

Who regulates crypto in Nebraska?

NDBF licenses money transmitters, kiosk operators and digital asset banks. The Legislature wrote the kiosk law, and the Attorney General warns the public about crypto scams, sued the SEC and has joined multistate briefs against Kalshi.

Timeline in two lanes. Regulator and law, 5 December 2024: Telcoin hearing set (Charter application heard). Regulator and law, 11 March 2025: LB 609 signed (Kiosk licensing and limits). Regulator and law, 3 September 2025: Kiosk law in force ($2,000 limit, 18% fee cap). Regulator and law, 12 November 2025: Telcoin bank chartered (Digital asset depository). Attorney General, 14 November 2024: AG sues the SEC (18-state coalition). Attorney General, 30 April 2025: Crypto scam alert (Fake sites, romance fraud). Attorney General, 16 January 2026: Kalshi brief, 9th Cir. (Backs California tribes). Attorney General, 12 June 2026: Kalshi brief, 6th Cir. (37 attorneys general).

  • NDBF and the Legislature. Governor Pillen signed LB 609, the Controllable Electronic Record Fraud Prevention Act, on 11 March 2025, and it took effect on 3 September 2025, according to NDBF’s industry update. Kiosk operators must hold a money transmitter licence, register each location, employ a full-time compliance officer and offer live support. New customers may transact no more than $2,000 a day and existing customers $10,500. Fees may not exceed 18% of a transaction. A customer defrauded at a kiosk who reports within 30 days gets a full refund if new, or the fees if existing, according to the Department’s FAQ.
  • Attorney General. Mike Hilgers issued a consumer alert on crypto scams on 30 April 2025, warning of fake trading sites with fabricated gains and of romance-led investment fraud. We found no suit by the state against a kiosk operator.

Unsettled. We found no cease-and-desist letter, lawsuit or court order from Nebraska officials against Kalshi, Polymarket or any other event-contract platform as of 20 October 2026, but the Attorney General has twice joined multistate briefs against Kalshi.

Hilgers signed the brief of 27 states and DC filed on 16 January 2026 in the Ninth Circuit, backing three California tribes in Blue Lake Rancheria v. Kalshi (No. 25-7504). On 12 June 2026 Nebraska was among 37 attorneys general defending state gambling law against Kalshi in the Sixth Circuit (KalshiEx LLC v. Schuler). Both are friend-of-the-court briefs: Nebraska is not a party.

According to AP reporting, Nebraska allows on-site sports betting at casinos next to racetracks, opened in 2023, and still bars online sportsbooks. Local reports say the Secretary of State certified two online sports wagering measures for the 3 November 2026 ballot on 21 August 2026. The federal side of the fight is in our United States guide. If Nebraska regulators act, the change will show in the rail beside this page.

How is crypto taxed in Nebraska?

Nebraska taxes income at graduated rates, and the top rate was 5.2% in 2025 on taxable income above $38,870 for a single filer. The Department of Revenue’s draft 2026 schedule cuts it to 4.55%. We found no Department guidance written for crypto, so the schedule applies to taxable income as for any other asset.

Step chart of Nebraska income tax rates for a single filer. In 2025 the rate rises in four steps from 2.46% to 5.2% above $38,870. In the 2026 draft schedule it is 2.46% up to $4,130, 3.51% to $24,760 and 4.55% above $24,760.

The 2025 schedule for a single filer is 2.46% up to $4,030, 3.51% to $24,120, 5.01% to $38,870 and 5.2% above. The draft 2026 schedule, marked “do not file” on 17 August 2026, shows 2.46% up to $4,130, 3.51% to $24,760 and 4.55% above, so the figures may change in the final version. Federal capital gains rules, which decide what counts as a gain, are in our United States guide.
