Is crypto legal in Delaware?
Yes. Owning and trading crypto is legal in Delaware, and since July 2026 a business that handles virtual currency for other people needs a licence from the State Bank Commissioner unless an exemption applies. Crypto kiosks are not banned: a ban passed the House but died in the Senate.
Delaware’s new act, Senate Bill 18, repeals the state’s money transmission chapter and replaces it with one covering money transmission and virtual currency. The Governor’s release of 7 July 2026 says it “creates a comprehensive licensing and supervisory framework for money transmitters and virtual currency businesses”. The General Assembly’s record shows it signed on 6 July, the release is dated 7 July. The bill takes effect at signing, but it is implemented at the earlier of one year after enactment or the day the Commissioner announces final rules, so the practical start date is still open.
The virtual currency subchapter of Title 5, chapter 23 says a person “may not engage in virtual-currency business activity” with or for another person unless licensed by the Commissioner or exempt. It does not reach people using virtual currency for their own personal, household or academic purposes, businesses expecting $5,000 or less of annual activity, or activity already governed by the federal Securities Exchange Act, the Commodity Exchange Act or the Delaware Securities Act. Ordinary holders are outside the licence.
Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Delawareans too. Both are covered in our United States guide.
Which crypto licences does Delaware require?
A virtual currency business needs a licence from the Office of the State Bank Commissioner under SB 18, which is still being implemented. Today all seven US exchanges we track show a Delaware money transmitter licence on their own pages: Coinbase, Gemini, Kraken, OKX US, Crypto.com, Bitstamp and Gate US.
We found no published list of Delaware licensees: the Commissioner’s site did not appear in our searches, so the NMLS Consumer Access search is the place to check a company. The licences below are the check seller and money transmitter licences the exchanges list for the dollar side of their business. Crypto.com links a Delaware licence document and Bitstamp lists Delaware among its states, without a number we could read.

Delaware residents who use Gemini contract with Gemini Moonbase, LLC rather than Gemini Trust Company. The user agreement assigns Delaware to the Moonbase entity, and Gemini’s Delaware page says Gemini “is available in Delaware” with a licence under the Gemini Trust Company number above.
Best crypto platforms for Delaware residents
By our access score inside Delaware, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Delaware resident can use each platform, not its fees or safety. It is the US score with Delaware’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has a Delaware-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit Delaware residents?
None of the platforms we track. We found no tracked exchange, prediction market or DeFi protocol that names Delaware as excluded or limited in its own terms, licence page or help centre, so Delaware residents get the same product list as the rest of the US.
The exclusions we did find name other states. Kraken does not serve New York and Maine and bars USD funding in Texas, New York and Maine. Crypto.com bars staking in New York, California, Maryland, New Jersey and Wisconsin. Gate does not operate in Alaska, Texas, Louisiana, New York, Washington and North Carolina, and OKX excludes New York and the territories. Coinbase bars staking for new principal in California, Maryland, New Jersey and Wisconsin and its prediction markets in Nevada and Michigan.
Two gaps remain. We could not read the state lists of Kalshi and Polymarket US, so their Delaware status rests on the absence of any exclusion. The Delaware licence pages of Crypto.com and Bitstamp show no number we could read.
Who regulates crypto in Delaware?
The Office of the State Bank Commissioner licenses money transmitters and, under SB 18, virtual currency businesses. The Department of Justice’s Investor Protection Unit freezes scam wallets, the General Assembly writes the rules, and Delaware’s federal courts sit in the Third Circuit, which backed Kalshi against New Jersey.

- Investor Protection Unit. On 28 September 2022 the Department of Justice issued a summary cease-and-desist order against 23 entities and individuals behind a pig-butchering scam, barring them from moving assets tied to two Delaware complainants. On 18 September 2023 a second order froze OKX wallets holding about $275,000 of a Delaware investor’s retirement savings. The release says OKX was not accused of wrongdoing.
- General Assembly. House Bill 441, a ban on crypto kiosks sponsored by Rep. Cyndie Romer, passed the House unanimously, but never left a Senate committee before the June 2026 adjournment. Romer said she is committed to bringing it back, so kiosks are still legal in Delaware for now. SB 18, introduced on 16 April 2026, passed and was signed in July.
- Commissioner. Implementation of SB 18 waits on the Commissioner’s final rules or the one-year mark, whichever comes first, according to Orrick’s summary. The package also signed SB 19, a state regime for payment stablecoin issuers modelled on the federal GENIUS Act.
Are prediction markets legal in Delaware?
We found no cease-and-desist letter, lawsuit or court order from any Delaware agency against Kalshi, Polymarket or Crypto.com. The Third Circuit, which covers Delaware, ruled on 6 April 2026 that Kalshi is likely to win its pre-emption argument against New Jersey.
In KalshiEX LLC v. Flaherty (No. 25-1922), decided 6 April 2026, the Third Circuit affirmed an injunction that stops New Jersey from enforcing its gambling law against Kalshi’s sports event contracts, because Kalshi “has demonstrated a reasonable chance of success” on its argument that federal commodities law pre-empts the state law. It decided only the injunction, not the merits, and other circuits have not all agreed: the Sixth Circuit sided with Ohio and Tennessee. The ruling is in a New Jersey case, so we cannot say how a Delaware court would apply it. Actions in other states are in our United States guide.
How is crypto taxed in Delaware?
Delaware taxes crypto gains as ordinary income at 0% to 6.6%. We found no separate rate for capital gains: the return starts from federal adjusted gross income, so a gain is added to your income and taxed at the 2025 rates, with the top 6.6% on income over $60,000.

The Division of Revenue’s 2025 schedule applies to every filing status. Tax is $2,943.50 plus 6.6% of the portion above $60,000. Line 1 of the PIT-RES return is federal adjusted gross income, and the 2025 standard deduction is $3,250 for a single filer and $6,500 for joint filers. We read no Delaware guidance specific to virtual currency. Federal capital gains rules are in our United States guide.
