Is crypto legal in Wisconsin?
Yes. Owning and trading crypto is legal in Wisconsin, and a firm that moves money for residents, including a crypto kiosk operator, needs a licence from the Department of Financial Institutions. There is no separate crypto licence.
Wisconsin regulates this under a money transmission law. The Department says 2023 Act 267 was signed by Governor Evers on 4 April 2024 and took effect on 1 January 2025, repealing the old seller of checks law and replacing it with the Model Money Transmission Modernization law. Companies that handle virtual currency “may be subject to” the law, depending on the nature of the transactions, and kiosk operators must be licensed under it. People who only hold crypto need no licence.
The wording is cautious because the state has no crypto-specific licence. Kraken’s own disclosures page carries a note beside its Wisconsin entry that the law “does not regulate virtual currency”, so a Wisconsin licence on a platform’s page does not by itself prove its crypto activity is licensed.
Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Wisconsinites too. Both are covered in our United States guide.
Which crypto licences does Wisconsin require?
A money transmitter licence from the Department of Financial Institutions, applied for through NMLS. Of the seven US exchanges we track, six list a Wisconsin licence on their own pages: Coinbase, Gemini, Kraken, OKX US, Gate US and Crypto.com. Bitstamp’s state list leaves Wisconsin out.
The Department points to NMLS Consumer Access rather than publishing its own licensee list, and that site could not be read for this guide, so the table shows what each exchange says on its own pages. Coinbase lists a “Seller of Checks License” (No. 238), the name of the licence under the old law. Crypto.com’s legal document links a Wisconsin licence file whose number could not be read.

A licence does not widen what an exchange offers. We found no page saying Bitstamp refuses Wisconsin residents, and the licences above sit beside the staking limits covered below.
Best crypto platforms for Wisconsin residents
By our access score inside Wisconsin, Coinbase (8.9 out of 10) and Gemini (8.4) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Wisconsin resident can use each platform, not its fees or safety. It is the US score with Wisconsin’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). Platforms that refuse Wisconsinites are not scored. The method is on our methodology page.

Which platforms block or limit Wisconsin residents?
Three cut back one product each, and none refuses Wisconsin residents: Coinbase and Kraken close staking, and Crypto.com closes exchange liquid staking. Wisconsin appears with California, Maryland and New Jersey on these staking lists.
Coinbase’s page dates the limit to notices from state securities agencies in June 2023. The same four states are on Kraken’s bitcoin staking list, which also names Maine, New York and Washington. For the strictest state, where three exchanges refuse residents, see the New York guide.
Who regulates crypto in Wisconsin?
The Department of Financial Institutions licenses money transmitters and crypto kiosk operators, the Attorney General has sued five platforms over sports event contracts, and the legislature has passed a kiosk law. We found no Wisconsin bill that licenses crypto exchanges separately.

- Department of Financial Institutions. The money transmission law took effect on 1 January 2025. The Department’s page says a kiosk fraud victim who reports to the operator and to the Department or police within 30 days of the transaction may be eligible for a refund.
- Kiosk law. The Department’s page cites 2025 Wisconsin Act 226 for its kiosk rules. WXPR reported on 19 March 2026 that the Senate passed the bill unanimously, with a $1,000 daily transaction limit, fee caps and a way for scam victims to recover losses.
- Attorney General. The suits against five platforms are covered in the next section.
Are prediction markets legal in Wisconsin?
Wisconsin says no for sports contracts. On 23 April 2026 the Attorney General sued Kalshi, Robinhood, Coinbase, Polymarket and Crypto.com, and no court order we found has stopped them serving the state. We found no cease-and-desist letter.
- 23 April 2026. The Department of Justice announced three complaints. WPR reports that the state says the platforms illegally facilitate sports betting through event contracts, wants them declared public nuisances and seeks a permanent injunction against sports event contracts. The Attorney General said the companies “thinly disguise” sports betting.
- 11 May 2026. In a separate case, a federal judge in the Western District of Wisconsin denied the Ho-Chunk Nation a preliminary injunction against Kalshi and Robinhood for lack of irreparable harm. The Nation’s claim under the Indian Gaming Regulatory Act against Kalshi survived a motion to dismiss.
The state is on the opposite side from North Carolina, which taxes prediction markets. The court record of the state’s own suits could not be read for this guide, so check the dockets for their current status.
How is crypto taxed in Wisconsin?
Crypto is taxed as property, as federally, and a gain is taxed at Wisconsin’s four rates from 3.5% to 7.65%. For assets held more than one year, 30% of the net capital gain is excluded.

Tax Bulletin 213 says taxpayers must report income, gains and losses on virtual currency as the Internal Revenue Code requires, and that buying, selling, sending or exchanging it may be a taxable event. The 2025 Schedule WD instructions let you exclude 30% of net capital gain from assets held more than one year. The Department’s rate page sets 3.5% up to $14,680 for single filers and $19,580 for joint filers, and 7.65% above $323,290 and $431,060.
