Is crypto legal in Florida?
Yes. Owning and trading crypto is legal in Florida, and a firm that receives crypto to transmit it for Floridians needs a money transmitter licence from the Office of Financial Regulation (OFR). Florida has no state income tax.
Since 1 January 2023, HB 273 has written virtual currency into chapter 560 of the Florida Statutes, the money services business law. A money transmitter is a firm that receives virtual currency to transmit it, and only an intermediary that can unilaterally execute or indefinitely prevent a transaction counts. Banks, credit unions and trust companies organised under state or federal law are exempt, and the chapter has no crypto-specific exemption. People who only hold crypto need no licence.
There is no state tax on personal income: Article VII of the Florida Constitution bars a tax on the income of natural persons, so crypto gains face federal tax only. Companies pay a 5.5% corporate income tax. Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Floridians too. Both are covered in our United States guide.
Which crypto licences does Florida require?
A money transmitter licence from the OFR. Of the seven US exchanges we track, six list a Florida licence on their own pages; Gemini lists none.
Crypto firms hold a “Money Transmitters Part II” licence. Coinbase, Crypto.com, OKX and Gate print their Florida licence numbers; Kraken and Bitstamp list Florida among their licensing states, and Bitstamp gives no number. Gemini has no Florida entry on its trust centre page, and we do not know why: its New York trust charter may fall under the trust company exemption, but Gemini does not say so.

The OFR holds the licensee register, and the exchange pages above are our source for who holds what, so check a firm’s number against the register before relying on it.
Best crypto platforms for Florida residents
By our access score inside Florida, Coinbase (8.9 out of 10) and Gemini (8.4) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Florida resident can use each platform, not its fees or safety. It is the US score with Florida’s own limits applied, and Florida has none: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). Platforms that refuse US users are not scored. The method is on our methodology page.

Which platforms block or limit Florida residents?
None of the platforms we track. We read each platform’s own terms, licence page and help centre for Florida and found no exclusion or limit, so a Floridian gets the same access as the US guide shows.
Other states are named instead. Coinbase and Gemini cut products for New York, Kraken, OKX US and Gate US refuse it, and Gate US also bars Alaska, Louisiana, North Carolina, Texas and Washington. Florida appears on these pages only as a licence entry, a complaint notice or an area where a service is open: Kraken lists it among the states with onchain staking, and Gemini’s Asset Rewards enrol Florida residents automatically. Our data holds no Florida-specific rows for that reason, and the table of every platform below shows the US status.
Who regulates crypto in Florida?
The OFR licenses and supervises crypto firms, the Attorney General prosecutes fraud, and the Gaming Control Commission polices gambling. Florida’s 2026 session passed a kiosk law and a stablecoin law, and failed every state crypto reserve bill.

- Kiosks. HB 505 was approved on 26 June 2026 and takes effect on 1 January 2027, with registration from 1 March 2027. A new customer, one who has used a kiosk for fewer than seven days, may transact $2,000 a day and an existing customer $10,000. Kiosk businesses must register with the OFR, licensed money transmitters are exempt from registering, and a customer who reports fraud within 60 days gets a full refund within 72 hours of a first transaction.
- Stablecoins. HB 175 was approved on 26 June 2026. Most of it applies from 1 October 2026 and creates an OFR licence for qualified payment stablecoin issuers, tied to the federal GENIUS Act.
- No state bitcoin reserve. The 2025 bitcoin investment bills (HB 487 and SB 550) died in June 2025, and in 2026 HB 1039, SB 1038 and HB 183 died when the session ended on 13 March. Florida has not bought crypto for a state fund.
- Central bank digital currency. SB 7054 was signed on 12 May 2023 and excludes a federal CBDC from the state’s definition of money.
- Attorney General. James Uthmeier opened an investigation into Robinhood Crypto on 10 July 2025 and issued a subpoena, and his office reported a record $5.4 million crypto recovery on 14 April 2026. We found no OFR enforcement order against a crypto exchange for 2024 to 2026.
Are prediction markets legal in Florida?
Not settled, and Florida has not acted. We found no cease-and-desist, lawsuit or order from the state against Kalshi, Polymarket US or any other event-contract platform, and no platform has geofenced Florida.
The Gaming Control Commission’s news page lists letters to offshore sportsbooks and sweepstakes casinos, but nothing on prediction markets. The disputes so far are private:
- 13 February 2026. A proposed class action, Keohohou v. North American Derivatives Exchange (No. 1:26-cv-20996), was filed in the Southern District of Florida against Crypto.com. It argues that Florida’s gambling statutes make its sports contracts void.
- 8 October 2026. The Seminole Tribe of Florida, which holds exclusive sports betting rights under its 2021 compact, sued DraftKings in Broward County court over its prediction market and Pick6, according to press reports. We have not read the complaint.
Two 2026 gambling bills, HB 189 and SB 1580, did not pass. For the federal fight over who regulates event contracts, see the United States guide.
