Yes. Owning and trading crypto is legal in Georgia, and the state has no crypto licence of its own: a firm that transmits crypto for customers needs a Georgia money transmitter licence.

The Department of Banking and Finance says in its virtual currency kiosk guidance that “transmission of Bitcoin and other virtual currencies also constitutes money transmission” under the Georgia money transmitter law, Code sections 7-1-680 to 7-1-698. Georgia has no BitLicense-style regime and no state list of approved coins.

Crypto kiosks are the one product with a Georgia law of their own. HB 945 passed in April 2026 and has been in force since 1 July 2026. Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Georgians too. Both are covered in our United States guide.

Which crypto licences does Georgia require?

A money transmitter licence from the Department of Banking and Finance. Of the seven US exchanges we track, six list a Georgia licence on their own pages: Coinbase, Gemini, Kraken, OKX US, Crypto.com and Gate US. We could not confirm one for Bitstamp.

There is no separate crypto licence, so each exchange’s licence is the standard one, and every exchange in the table keeps the federal limits described in our United States guide. Coinbase lists Georgia on its licence page without a number, and OKX US lists a seller of payment instruments licence rather than a money transmitter licence. No exchange we track names Georgia as a state it excludes.

Table of seven exchanges that serve US residents. Coinbase: money transmitter licence, no number listed, limited; Gemini: money transmitter licence 52628, limited; Kraken: money transmitter licence 66683, limited; OKX US: payment instruments licence 64756, limited; Crypto.com: money transmitter licence 1966158, limited; Bitstamp: no Georgia licence confirmed, limited; Gate US: state licence licence 2272810, limited.

The Department enforces the line against unlicensed platforms. It made its cease and desist order against the exchange WEEX final on 27 March 2025, and against Crypto Dispensers final on 16 January 2026, in both cases for running an online virtual currency trading platform in Georgia without a licence or exemption.

Best crypto platforms for Georgia residents

By our access score inside Georgia, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully a Georgia resident can use each platform, not its fees or safety. It is the US score with Georgia’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). Platforms that refuse Georgians are not scored. The method is on our methodology page.

Which platforms block or limit Georgia residents?

None of the 11 tracked platforms that serve the US names Georgia as excluded or limited in the documents we read, so Georgia has the same access as the US as a whole.

Each platform that cuts states back names them: Coinbase carves out staking in California, Maryland, New Jersey and Wisconsin, prediction markets in Nevada and Michigan and loans in New York, Kraken and OKX do not serve New York, and Bitstamp does not serve Hawaii or Nevada. Gate US lists seven jurisdictions where it does not operate (Alaska, Texas, Louisiana, the US Virgin Islands, New York, Washington and North Carolina), and Georgia is not among them. The dataset therefore holds no Georgia row for any platform. Our US rows show what is cut nationally, and they apply here unchanged.

Who regulates crypto in Georgia?

The Department of Banking and Finance licenses money transmission and polices unlicensed platforms, the Secretary of State polices crypto investment schemes under the securities act, and the General Assembly sets kiosk and other rules. We found no Attorney General crypto action.

Timeline in three lanes. Banking Dept, 27 March 2025: WEEX order final (Unlicensed trading platform). Banking Dept, 16 January 2026: Crypto Dispensers order final (Unlicensed trading platform). Securities, 18 December 2024: Trage emergency order (Unregistered trading programme). Legislature, 3 April 2026: HB 945 passed (Crypto kiosk limits). Legislature, 1 July 2026: HB 945 in force (18% fee cap).

  • Banking and Finance. The Department treats crypto transmission as money transmission and enforces it with cease and desist orders, including WEEX (final 27 March 2025) and Crypto Dispensers (final 16 January 2026).
  • Secretary of State. On 18 December 2024 the Secretary of State issued an emergency order against Trage Technologies Limited and affiliates under the Georgia Uniform Securities Act of 2008, over an unregistered crypto trading programme.
  • General Assembly. HB 945 sets a fee cap of 18% of the cash exchanged and daily limits of $2,500 for new kiosk customers and $10,000 for existing ones. Operators must also show a fraud warning, refund new customers scammed within 72 hours, offer live phone support and employ a compliance officer.

Not settled. Georgia has no legal sports betting, but we found no Georgia agency or court order that blocks Kalshi or another prediction market, and the one lawsuit is a private claim for gambling losses.

  • February 2026. Georgia Gambling Recovery LLC sued Kalshi in the Middle District of Georgia under the state’s gambling loss recovery law. In February 2026 the federal court denied a motion to send it back to state court, according to Covers, which also reports no state action blocking Kalshi access (page updated 15 October 2026).
  • 6 March 2026. The Georgia House rejected HR 450, a constitutional amendment to legalise sports betting, by 63 votes to 98; it needed 120.

Without a state order, Kalshi and Polymarket US keep their US status in Georgia. States that have acted are covered in our United States guide.

How is crypto taxed in Georgia?

Georgia charges a flat 4.99% state income tax for 2026, down from 5.19%, and we found no Georgia rule that treats crypto differently from other income. Federal tax comes on top.

HB 463 reduces the personal and corporate rate from 5.19% to 4.99% for 2026. BDO notes that further cuts of 0.125 percentage points a year, down to a floor of 3.99%, depend on the state meeting revenue targets, so they are not guaranteed for 2027. We did not find Department of Revenue guidance written for crypto. Federal capital gains rules are in our United States guide.
