Yes. Owning and trading crypto is legal in Pennsylvania, and since 26 August 2025 a firm that transmits virtual currency for a fee on behalf of an individual needs a Pennsylvania money transmitter licence.

There is no separate crypto licence. Act 7 of 2025 (Senate Bill 202), signed on 27 June 2025, extended the Money Transmitter Act to virtual currency, and the Department of Banking and Securities says Pennsylvania is now “one of 27 states” that regulate virtual currency under that act. The Department’s letter to licensees bars anyone from “transmitting virtual currency by means of a transmittal instrument for a fee or other consideration with or on behalf of an individual” without a licence, and says there was no grace period when the law took effect.

Before that, the Department had applied a Virtual Currency Statement of Policy from 15 October 2024 (published 20 April 2024) that read “money” in the act to include Bitcoin. It was rescinded when Act 7 took effect.

Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Pennsylvanians too. Both are covered in our United States guide.

Which crypto licences does Pennsylvania require?

A money transmitter licence from the Department of Banking and Securities. Six of the seven US exchanges we track list one: Coinbase, Gemini, Kraken, OKX US, Crypto.com and Gate US. Bitstamp’s licence page names no Pennsylvania licence.

Licences are applied for through the national NMLS system, and each exchange shows its Pennsylvania number on its own licence page. Every exchange in the table keeps the federal limits described in our United States guide.

Table of seven exchanges that serve US residents. Coinbase: money transmitter licence 51015, limited; Gemini: money transmitter licence 110564, limited; Kraken: money transmitter licence 110992, limited; OKX US: money transmitter licence 110665, limited; Crypto.com: money transmitter licence, no number listed, limited; Gate US: money transmitter licence 119607, limited; Bitstamp: no Pennsylvania licence listed, limited, lists no Pennsylvania licence.

The Bitstamp gap is a lead, not a finding. Its US legal page lists 40 jurisdictions whose regulators issued its money transmitter licence and Pennsylvania is not among them, but the page names no state it excludes, so we keep its US status for Pennsylvania until Bitstamp says otherwise.

Crypto kiosks have no rules of their own yet. Senate Bill 1015 would add anti-fraud warnings, 24-hour customer support and a money transmitter licence for kiosk operators. Two Senate committees heard it on 8 April 2026, where the Attorney General’s office reported 90 complaints about crypto fraud and $12.3 million in losses, and we found no vote since.

Best crypto platforms for Pennsylvania residents

By our access score inside Pennsylvania, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully a Pennsylvania resident can use each platform, not its fees or safety. It is the US score with Pennsylvania’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). The method is on our methodology page.

Which platforms block or limit Pennsylvania residents?

None that we track. Every one of the 11 platforms that serve the US serves Pennsylvania on the same terms as the rest of the country, and none names Pennsylvania in its list of excluded states.

We read each platform’s own licence page, terms and help pages for the state. Where platforms do cut states back, Pennsylvania is absent from the lists: Gate stays out of Alaska, Louisiana, New York, North Carolina, Texas, Washington and the US Virgin Islands; OKX excludes New York and the territories; Kraken withholds FedWire and ACH funding only in Texas, New York and Maine; and Coinbase limits staking in California, Maryland, New Jersey and Wisconsin. The Bitstamp licence gap above is the one open question. Platforms that refuse all US users are covered in our United States guide.

Who regulates crypto in Pennsylvania?

The Department of Banking and Securities licenses crypto transmitters under Act 7, the Gaming Control Board and the Attorney General argue that prediction markets are gambling, and the Legislature has passed no crypto law since Act 7.

Timeline in three lanes. Banking and Securities, 15 October 2024: Statement of Policy applies (Bitcoin counts as money). Banking and Securities, 26 August 2025: Act 7 licensing starts (No grace period). Legislature, 27 June 2025: Act 7 signed (SB 202). Legislature, 8 April 2026: Kiosk bill hearing (SB 1015). Courts and Gaming, 6 April 2026: Third Circuit: Kalshi v. NJ (Sports contracts likely swaps). Courts and Gaming, 30 April 2026: Gaming Board letter (Opposes sports contracts).

  • Banking and Securities. It licenses money transmitters, including virtual currency firms since 26 August 2025. Lookups run through NMLS Consumer Access, and we found no crypto enforcement order against an exchange from 2022 to 2026.
  • Attorney General. The Bureau of Consumer Protection told senators on 8 April 2026 it had received 90 complaints about crypto fraud totalling $12.3 million, and that 85% of the victims were 60 or older. Attorney General Dave Sunday also signed a July 2026 letter from 44 attorneys general that calls prediction markets “a new form of casino”, per Spotlight PA.
  • Legislature. Beyond Act 7 and the kiosk bill, we found no 2025 to 2026 bill on a state bitcoin reserve or bitcoin rights: the House passed a bitcoin rights bill in October 2024 and it died with the session.

Not settled. Its Gaming Control Board opposes sports event contracts, but we found no order, lawsuit or cease-and-desist against Kalshi or Polymarket, and the Third Circuit has ruled for Kalshi in a New Jersey case.

The Board told the CFTC on 30 April 2026 that it has “profound opposition” to contract markets acting as unregulated sportsbooks. Spotlight PA reported on 3 September 2026 that the Board declined to comment further because Pennsylvania “might launch or join a lawsuit”, and that no suit or order existed then.

The ruling closest to home is KalshiEX v. Flaherty, decided on 6 April 2026 by the Third Circuit, which covers Pennsylvania. It kept in place an injunction that stops New Jersey from enforcing its gambling law against Kalshi’s sports contracts. It is not an order about Pennsylvania, and other circuits have gone the other way. Kalshi and Polymarket US keep their US status in Pennsylvania. States that have acted are covered in our United States guide.

How is crypto taxed in Pennsylvania?

Pennsylvania taxes income at a flat 3.07%. A loss in one class of income cannot offset income in another class.

The Department of Revenue’s personal income tax page says the tax is “levied at the rate of 3.07 percent” and that Pennsylvania “taxes eight classes of income”, with no offset of a loss in one class against another. The page does not mention crypto and we found no Department guidance on it, so how a disposal is classed is a reading of those eight classes: check it with a Pennsylvania tax adviser. Federal capital gains rules are in our United States guide.
