Yes. Owning and trading crypto is legal in Idaho, and we found no crypto-specific licence: exchanges that handle customers’ dollars hold an ordinary money transmitter licence from the Department of Finance. Idaho has no crypto kiosk law, because the governor vetoed one on 8 April 2026.

The licence pages of Coinbase, Gemini and OKX each name the Idaho Department of Finance, Securities Bureau as the issuer of an Idaho money transmitter licence. We found no separate Idaho licence for virtual currency and no list of approved coins. The Department’s own website refused our connection, so the licence facts below come from the exchanges’ pages and the legislative facts from a news report and a court opinion.

Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Idahoans too. Both are covered in our United States guide.

Which crypto licences does Idaho require?

None for crypto as such that we found. A firm that moves customers’ dollars needs an Idaho money transmitter licence, and three of the seven US exchanges we track show one on their own pages: Coinbase (MTL-169), Gemini (MTL-218) and OKX US (MTL-251).

The Coinbase licence page lists “Idaho Money Transmitters License, MTL-169”. Gemini’s Idaho page says “Gemini is available in Idaho”, names MTL-218 and offers USD as the only fiat currency. The OKX US licence page lists “Money Transmitters, #MTL-251” for token-to-token and USD-to-token trades.

Table of seven exchanges that serve US residents. Coinbase: money transmitter licence MTL-169, limited; Gemini: money transmitter licence MTL-218, limited; Kraken: licence not shown on its page, limited; OKX US: money transmitter licence MTL-251, limited; Crypto.com: licence not shown on its page, limited; Bitstamp: licence not shown on its page, limited; Gate US: licence not shown on its page, limited.

Kraken, Gate and Bitstamp publish no Idaho licence we could read, and Crypto.com publishes none on a page we could load. A missing licence on a page is not proof the company holds none. What its pages do say: the Crypto.com help centre lists Idaho among the 49 states where its App is available (page dated 15 September 2025), and Kraken’s licensing page names no Idaho exclusion.

Best crypto platforms for Idaho residents

By our access score inside Idaho, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully an Idaho resident can use each platform, not its fees or safety. It is the US score with Idaho’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has an Idaho-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit Idaho residents?

None of the platforms we track. We found no tracked exchange, prediction market or DeFi protocol that names Idaho as excluded or limited in its own terms, licence page or help centre, so Idaho residents get the same product list as the rest of the US.

The exclusions we did find name other states. Kraken’s licensing page says it does not serve Maine and New York, bars EUR in Texas and New Hampshire, and turns off fiat transfers in Indiana, Louisiana, Massachusetts and Utah. The Crypto.com help centre lists 49 states for its App, and Idaho is one of them.

Idaho’s one live question is not about platforms: it is the missing kiosk law below. Residents can still buy and trade crypto online.

Who regulates crypto in Idaho?

The Department of Finance licenses money transmission, and the Legislature has so far failed to pass a kiosk law: Governor Brad Little vetoed SB 1359a on 8 April 2026 and lawmakers cannot override it.

  • Department of Finance. Its Securities Bureau issues the money transmitter licences that Coinbase, Gemini and OKX US show on their pages, at 800 Park Boulevard in Boise.
  • Legislature and governor. SB 1359a would have made crypto kiosk operators register with the state, disclose fees and exchange rates, post fraud warnings, keep transaction records and apply transaction limits. The Legislature adjourned on 2 April 2026, and on 8 April the governor vetoed it, saying it “contains critical drafting deficiencies that would undermine its own purpose” (report of 9 April 2026). Because lawmakers adjourned rather than recessed, they cannot override without calling themselves back into a special session.
  • Attorney General. We found no Idaho Attorney General action against a crypto platform.

Unsettled. We found no Idaho action against Kalshi, Polymarket or any other platform. Idaho sits in the Ninth Circuit, which held on 28 August 2026 that federal law likely does not pre-empt Nevada’s gaming rules for Kalshi’s sports contracts.

The Ninth Circuit’s opinion in KalshiEX v. Assad (No. 25-7516) affirmed in part the dissolution of Kalshi’s preliminary injunction against the Nevada Gaming Control Board and remanded in part. It concerns Nevada, but the court’s reading of the Commodity Exchange Act is the law in every Ninth Circuit state, Idaho included. It does not mean Idaho has acted: we found no Idaho cease-and-desist letter, lawsuit or bill on event contracts, so the pick lists above keep the US status for Kalshi and Polymarket. Actions in other states and the federal side are in our United States guide.

How is crypto taxed in Idaho?

Idaho charges a flat 5.3% state income tax, the rate set by H.B. 40 for 2025 and listed by the Tax Foundation for 2026. We found no separate Idaho rate or break for crypto gains.

EY’s report says Governor Brad Little signed H.B. 40 on 6 March 2025, lowering the rate for individuals, trusts and estates from 5.695% to 5.3%, retroactive to 1 January 2025, on income exceeding $2,500 ($5,000 for married persons filing jointly). The Tax Foundation still lists “a flat 5.30 percent individual income tax rate” for 2026. The Idaho State Tax Commission’s site refused our connection, so confirm the rate and the zero-rate band there before you file. Federal capital gains rules are in our United States guide.
