Yes. Owning and trading crypto is legal in Maine, but a business that exchanges, transfers or stores virtual currency for other people needs a money transmitter licence from the state. Maine has no separate crypto licence.

Maine’s Money Transmission Modernization Act, enacted as Public Law 2023, chapter 662, has a section on virtual currency. Under section 6100-QQ, no one may engage in virtual currency business activity with or for another person unless they hold a Maine licence or are exempt. Section 6100-OO defines that activity as exchanging, transferring or storing virtual currency, or administering it. Holding your own coins needs no licence.

Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Mainers too. Both are covered in our United States guide.

Which crypto licences does Maine require?

A money transmitter licence from the Bureau of Consumer Credit Protection, the same licence that covers dollars, with kiosk operators held to extra rules. Of the seven US exchanges we track, Gemini, OKX US and Gate US show a Maine licence on their own pages.

There is no BitLicense-style regime and no list of approved coins. The Bureau’s pages on maine.gov returned an access error to every request we made on 20 October 2026, so we could not read its licensee list, and we do not claim a licence for any exchange that does not state one itself. Gemini’s Maine page lists a money transmitter licence, OKX US lists one on its US licences page, and Gate US says it is licensed in Maine; none of the three shows a licence number we could use. Coinbase, Crypto.com and Bitstamp are not confirmed here. Kraken holds no Maine licence we could find, and does not serve the state.

Kiosks have their own rules. Under 32 MRSA section 6169, in force since 12 June 2025, an operator may not accept or dispense more than $1,000 a day from or to a customer, may not charge more than the greater of $5 or 3% of the dollar value of a transaction, and must refund a customer who was induced by fraud or an unfair practice, within 90 days of the customer’s first transaction. A second law, Public Law 2025, chapter 542, signed on 3 March 2026, says a cash-dispensing machine may not operate as a virtual currency kiosk unless its operator is a licensed money transmitter.

Best crypto platforms for Maine residents

By our access score inside Maine, Gemini (8.4 out of 10) and Coinbase (7.9) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully a Maine resident can use each platform, not its fees or safety. It is the US score with Maine’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). Platforms that refuse Mainers are not scored. The method is on our methodology page.

Which platforms block or limit Maine residents?

One: Kraken. It stopped serving Maine residents on 1 June 2024 and lists Maine and New York as the two states it does not serve. We found no other tracked platform that names Maine as excluded or limited.

Kraken’s page on changes for US clients says it halted services for Maine residents from 1 June 2024, citing “specific state-level considerations”, and asked clients to withdraw funds before 12 April 2025. Assets left after that date were “classified as abandoned and escheated to the state of Maine”. The page names no Maine statute or regulator action, and we found none linking the exit to one. Kraken’s licensing page, updated on 30 September 2026, still lists Maine among the places it does not serve.

Who regulates crypto in Maine?

The Bureau of Consumer Credit Protection licenses money transmitters, including crypto businesses and kiosk operators, and the Legislature has written two kiosk laws since 2025. We found no Attorney General action on crypto.

Timeline in three lanes. Platforms, 1 June 2024: Kraken leaves Maine (Services halted). Platforms, 12 April 2025: Withdrawal deadline (Leftovers escheated). Regulator, 5 January 2026: Bitcoin Depot settles ($1.9 million recovered). Legislature, 12 June 2025: Kiosk Act in force (Licence, $1,000 daily cap). Legislature, 3 March 2026: Kiosk machine law (LD 1998 signed).

  • Bureau of Consumer Credit Protection. On 5 January 2026 it announced a consent agreement with kiosk operator Bitcoin Depot that recovers $1.9 million taken from Maine consumers by third-party scammers; the company agreed to follow Maine’s consumer protection laws so it can operate as a licensed money transmitter. We read this through local news coverage, because the Bureau’s own press release was not reachable.
  • Legislature. The Virtual Currency Kiosk Act took effect on 12 June 2025 as an emergency measure, and LD 1998 was enacted and signed on 3 March 2026 as Public Law 2025, chapter 542.
  • Kraken. The exchange itself is the biggest change for residents: see the section above.

Unsettled, and quiet. In our search of Maine regulator, Attorney General and Legislature sources we found no cease-and-desist letter, lawsuit, court order or bill about Kalshi, Polymarket or other event contracts.

That is an absence in search results, not a ruling: Maine’s own government pages were not reachable for us on 20 October 2026, so this section may be behind events. Nothing we could read bars a platform from serving the state, so the pick lists above keep the US status for Kalshi and Polymarket. The fight in other states, and the federal side, are in our United States guide.

How is crypto taxed in Maine?

Maine taxes income at 5.8%, 6.75% and 7.15%, with a 2% surcharge from 2026 on taxable income over $1 million for single filers. We found no Maine page that sets a separate rule for crypto, so check federal treatment in our United States guide.

Bar chart of Maine income tax rates for a single filer: lowest rate 5.8%, middle rate 6.75%, top rate 7.15%, top rate over $1m 9.15%. Below: three rates apply for tax years from 2017 (5.8%, 6.75% and 7.15%); a 2% surcharge applies from 2026 on Maine taxable income over $1 million for single filers, and over $1.5 million for joint filers and heads of household.

The rates are set in 36 MRSA section 5111: 5.8%, 6.75% and 7.15% for tax years beginning in 2017 or later, and a 2% surcharge from 1 January 2026 on Maine taxable income above $1 million for single filers and above $1.5 million for heads of household and joint filers. Maine Revenue Services publishes the indexed bracket thresholds each year; its site was not reachable for us, so the chart shows the rates, not the thresholds. Federal capital gains rules are in our United States guide.
