Is crypto legal in New Hampshire?
Yes. Owning and trading crypto is legal in New Hampshire, and the state has no crypto licence. Its Banking Department says it does not license businesses that deal only in convertible virtual currency; a firm that handles dollars still needs a money transmitter licence.
The Banking Department’s position paper reads RSA 399-G:3 that way: businesses dealing solely in virtual currency are outside the licence, stay under the state Consumer Protection Act, and anyone handling fiat, or fiat and crypto, needs a licence. The law was rewritten in 2024: Governor Sununu signed HB 1241 on 23 August 2024, which brought RSA 399-G closer to the model act of the Conference of State Bank Supervisors. We could not confirm whether the rewrite kept the virtual-currency exemption word for word.
New Hampshire has no wage tax and no tax on crypto gains (see the tax section below). Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse New Hampshire residents too. Both are covered in our United States guide.
Which crypto licences does New Hampshire require?
None for crypto as such. A firm that holds customers’ dollars needs a Banking Department money transmitter licence, and New Hampshire also charters trust companies: Crypto.com’s custody arm, Foris DAX Trust Company, holds one.
New Hampshire has no BitLicense-style regime and no list of approved coins, and we found no public licensee list or count. Of the seven exchanges we track, two show a New Hampshire licence on their own pages: OKX lists money transmitter licence MT 1767779 on its US licences page, and Coinbase’s licence page lists MT 19523 (read through a search summary, because the page blocks automated requests). Gemini, Kraken, Bitstamp and Gate US name no New Hampshire licence that we could read. That is a gap in what we could read, not proof that they hold none.

Best crypto platforms for New Hampshire residents
By our access score inside New Hampshire, Gemini (8.4 out of 10), Kraken (8.3) and Coinbase (7.9) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a New Hampshire resident can use each platform, not its fees or safety. It is the US score with New Hampshire’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). Only Kraken has a New Hampshire-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit New Hampshire residents?
One of the platforms we track. Kraken says residents of New Hampshire and Texas cannot deposit or hold EUR or trade EUR pairs. We found no tracked platform that excludes New Hampshire outright.
Kraken’s licensing page, updated on 30 September 2026, carries the EUR exclusion. The page names no other New Hampshire limit.
The other exclusions we found name other states. Kraken bars bank funding in Texas, New York and Maine, Crypto.com bars the App in New York only, and OKX excludes New York and the territories. Kiosks are not platforms: New Hampshire’s kiosk limits, covered below, do not stop residents buying and trading crypto online.
Who regulates crypto in New Hampshire?
The Banking Department licenses money transmission and trust companies, the Bureau of Securities Regulation polices investment schemes, and the General Court writes the crypto rules: a bitcoin reserve law in 2025 and kiosk limits in 2026.

- Banking Department. HB 1241, signed on 23 August 2024, rewrote the money transmission law. The Department’s position is that it does not license firms dealing solely in convertible virtual currency.
- Bitcoin reserve. Governor Kelly Ayotte signed HB 302 on 6 May 2025. It lets the state treasurer invest up to 5% of public funds in precious metals and in digital assets with an average market cap of at least $500 billion over the last calendar year, a test only bitcoin passes.
- Crypto kiosks. The House passed SB 482 by 214 to 140 on 23 April 2026, and Governor Ayotte signed it on 19 June 2026. The New Hampshire Bulletin reports a cap of $2,000 per customer per day and a refund window for reported fraud, with the limits starting on 16 December 2026. New Hampshire chose limits over the outright ban that police chiefs asked for. We could not open the enrolled text, so check the final terms on the General Court site before relying on them.
- Securities Bureau. Its enforcement orders are posted on the Secretary of State’s site, which we could not open, so we list none. We found no New Hampshire Attorney General lawsuit against a crypto exchange.
Are prediction markets legal in New Hampshire?
Unsettled. We found no New Hampshire cease-and-desist letter, lawsuit or court order against Kalshi, Polymarket or any other event-contract platform, but a state senator said on 2 April 2026 that he would file a bill to let the state sue them.
New Hampshire legalized sports betting in 2019 and has collected more than $170 million through its partnership with DraftKings, so its Lottery Commission has a revenue stake. NHPR reported that Senator Tim Lang planned legislation to clear the way for New Hampshire to sue the companies, and that neither Kalshi nor Polymarket has an agreement with the state. The report gives no bill number and we could not find whether it passed, so the pick lists above keep the US status for both platforms. Actions in other states, and the federal side, are in our United States guide.
How is crypto taxed in New Hampshire?
New Hampshire taxes no crypto gains. It has no wage tax, and its tax on interest and dividends, once 5%, was repealed for periods from 1 January 2025, so only federal tax applies to a gain. Companies pay a business profits tax and a business enterprise tax.
A McLane Middleton note on the repeal says taxpayers are no longer subject to the interest and dividends tax from 1 January 2025, after rates of 5%, then 4% and 3% in earlier years. We could not open the Department of Revenue Administration’s own pages, so we treat this as secondary. Federal capital gains rules are in our United States guide. Exchanges based in the state pay the business profits tax and business enterprise tax; we could not confirm the current rates from a primary source, so we do not quote them.
