Yes. Oklahoma law says the state may not stop residents from paying with crypto or holding it in their own wallet, and it has no BitLicense-style crypto licence. Crypto kiosks are licensed and capped.

House Bill 3594, in force since 1 November 2024, bars the government from prohibiting, restricting or impairing a person’s ability to “use digital assets to purchase legal goods or services” or to self-custody digital assets in a self-hosted or hardware wallet. The same law says home miners, mining businesses, stakers and staking-as-a-service providers do not need a money transmitter licence, and that running a node is legal.

Money transmission is licensed by the State Banking Department. Its current rule book, the Financial Transaction Reporting Act, is replaced from 1 November 2026 by House Bill 3521, the Oklahoma Money Transmission Modernization Act. Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Oklahomans too. Both are covered in our United States guide.

Which crypto licences does Oklahoma require?

No crypto-specific licence. A company that moves customers’ money needs a money transmitter licence from the Banking Department, and all seven US exchanges we track appear on its licensee list: Coinbase, Gemini, Kraken, OKX US, Crypto.com, Bitstamp and Gate US. Kiosk operators need one too.

The Department publishes a licensee list of company names and cities, with no licence numbers and no date. The exchanges appear under their operating entities: Coinbase, Inc.; Payward Interactive, Inc. (Kraken); Gemini Moonbase, LLC; OKX INC.; Foris DAX, Inc. (Crypto.com); Bitstamp USA, Inc.; and Gate US, Inc. Gemini’s Oklahoma page also lists a trust-related registration and a sale of checks licence with the Banking Department.

Table of seven exchanges that serve US residents, all on the Oklahoma money transmitter licensee list. Coinbase: money transmitter licence, listed as Coinbase, Inc., limited; Gemini: money transmitter licence, listed as Gemini Moonbase, LLC, limited; Kraken: money transmitter licence, listed as Payward Interactive, Inc., limited; OKX US: money transmitter licence, listed as OKX INC., limited; Crypto.com: money transmitter licence, listed as Foris DAX, Inc., limited; Bitstamp: money transmitter licence, listed as Bitstamp USA, Inc., limited; Gate US: money transmitter licence, listed as Gate US, Inc., limited.

The new act defines “money transmission” as selling or issuing payment instruments or stored value, receiving money for transmission, and payroll processing. Its definition of money reaches only stablecoin that is pegged to a sovereign currency, fully backed and redeemable. It names crypto directly for kiosk operators and for firms providing digital asset services, which must post a surety bond of at least $500,000. We read it as leaving a plain coin-for-coin exchange outside the licence, but we have not seen the Department confirm that.

Best crypto platforms for Oklahoma residents

By our access score inside Oklahoma, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.

The score rates how fully an Oklahoma resident can use each platform, not its fees or safety. It is the US score with Oklahoma’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform has an Oklahoma-specific cut, so the scores track the US ones. The method is on our methodology page.

Which platforms block or limit Oklahoma residents?

None of the platforms we track. We found no tracked exchange, prediction market or DeFi protocol that names Oklahoma as excluded or limited in its own terms, licence page or help centre, so Oklahoma residents get the same product list as the rest of the US.

The exclusions we did find name other states. Kraken serves every state except New York and Maine. Crypto.com bars staking in New York, California, Maryland, New Jersey and Wisconsin. Gate does not operate in Alaska, Texas, Louisiana, New York, Washington and North Carolina, and OKX excludes New York and the territories. Several platform pages were not readable when we checked, so a silent page is not proof: we re-check the rows when a platform publishes a state list.

Kiosks are rules on machines, not on platforms: Oklahomans can still buy and trade crypto online.

Who regulates crypto in Oklahoma?

The State Banking Department licenses money transmitters and now kiosk operators, the Legislature writes the rules and protects self-custody, and the Attorney General warns the public about crypto scams and joined the 18-state suit against the SEC.

Timeline in three lanes. Regulators, 1 November 2025: Kiosk law in force (Licence, $500,000 bond, $50 per site). AG, 19 March 2024: Bitcoin ATM warning (Only scammers demand crypto). AG, 19 November 2024: AG sues the SEC (18-state coalition). AG, 7 April 2026: Scam ads warning (Crypto payments are irreversible). Legislature, 1 November 2024: HB 3594 in force (Self-custody protected). Legislature, 29 May 2025: Veto overridden (SB 1083, kiosk licensing). Legislature, 6 May 2026: New transmission act (HB 3521, in force 1 Nov 2026).

  • Banking Department. Since 1 November 2025 operators of crypto kiosks must hold a money transmitter licence, post a $500,000 bond and pay $50 per location, according to the Department’s memo to licensees.
  • Legislature. Senate Bill 1083 set the kiosk rules: new customers may send no more than $2,000 a day, fees and spreads are capped at 15% of the dollar value, and a new customer who reports fraud to the operator and the Attorney General within 14 days is owed a full refund. Operators must staff a live support line, and unlicensed operation is a misdemeanor punished by a fine of $600 to $2,000 per violation, with kiosk seizure. The governor vetoed the bill, saying it created “yet another license”, and the Legislature overrode him on 29 May 2025. House Bill 3521 passed on 6 May 2026 and takes effect on 1 November 2026.
  • Attorney General. Gentner Drummond warned consumers about bitcoin ATM scams on 19 March 2024 and about scam investment ads on 7 April 2026. On 19 November 2024 he and 17 other attorneys general sued the SEC over its crypto rules. We found no suit by the state against a kiosk operator.

Unsettled. We found no cease-and-desist letter, lawsuit or court order from Oklahoma officials against Kalshi, Polymarket or any other event-contract platform as of 20 October 2026, so the pick lists above keep the US status for both.

Other states have acted, and a federal appeals court has already ruled on a state’s gambling law against Kalshi. Those actions and the federal side are in our United States guide. If Oklahoma regulators act, the change will show in the rail beside this page.

How is crypto taxed in Oklahoma?

Oklahoma taxes income at graduated rates, and from tax year 2026 the top rate is 4.5% on taxable income above $7,200 for a single filer, down from 4.75%. We found no Tax Commission guidance written for crypto, so the state schedule applies to taxable income as for any other asset.

Step chart of Oklahoma income tax rates for a single filer. In 2025 the rate rises in six steps from 0.25% to 4.75% above $7,200. From 2026 it is 0% up to $3,750, 2.5% to $4,900, 3.5% to $7,200 and 4.5% above $7,200.

According to the Tax Commission’s revenue impact statement for House Bill 2764, a single filer paid 0.25% to 4.75% across six brackets in 2025. From 2026 the rates are 0% up to $3,750, 2.5% to $4,900, 3.5% to $7,200 and 4.5% above that. The same bill lets the top rate fall by 0.25 points when revenue targets are met, with the first possible cut in tax year 2028. The statement covers the committee version of the bill, and we show single-filer figures only. Federal capital gains rules, which decide what counts as a gain, are in our United States guide.
