Is crypto legal in Colorado?
Yes. Owning and trading crypto is legal in Colorado, and the state has no crypto licence of its own: a firm needs a money transmitter licence from the Division of Banking only when it handles dollars or stablecoins for customers.
The Division draws that line in interim guidance of 18 December 2025 on the Money Transmission Modernization Act, which HB25-1201 enacted on 18 April 2025 and which took effect on 6 August 2025. Virtual currency is not “money” under the Act, so receiving or selling it is not money transmission. Payment stablecoins count as stored value, so selling one needs a licence unless the issuer is a federally qualified one, which the federal GENIUS Act exempts from state licensing. The guidance can be changed or withdrawn by the Banking Board.
Colorado briefly had a crypto-specific law. The Colorado Digital Token Act of 2019 (SB19-023) exempted some utility tokens from securities registration, and SB24-180 repealed it on 17 May 2024.
Crypto kiosks have their own rules since 1 January 2026. Under SB25-079, the Colorado Vending of Digital Assets Act, operators must show risk disclosures, give an electronic receipt and cap daily transactions at $2,000 for a customer of under 7 days and $10,500 after that. A first transfer to a wallet or exchange outside the United States must be refunded in full if the customer reports the fraud within 60 days with proof.
Federal rules from the SEC, CFTC, Treasury and IRS apply on top, as in every state, and offshore exchanges that refuse US users refuse Coloradans too. Both are covered in our United States guide.
Which crypto licences does Colorado require?
A money transmitter licence from the Division of Banking, but only for firms that handle dollars or stablecoins. Of the seven US exchanges we track, five publish a Colorado licence: Coinbase, Gemini, Kraken, OKX US and Crypto.com. Bitstamp and Gate US list none.
Colorado has no BitLicense-style regime and no list of approved coins. Each licence number below comes from the exchange’s own licence page, read on 20 October 2026 and not checked against the Division’s register. Bitstamp serves Colorado under its US terms, but its licence page names no Colorado licence. Gate does not list Colorado among the jurisdictions where it does not operate, and its licence table has no Colorado row either. We read both silences as unresolved rather than as a block.

Gemini lists a second Colorado number, 500334, for its Moonbase entity.
Best crypto platforms for Colorado residents
By our access score inside Colorado, Coinbase (8.9 out of 10), Gemini (8.4) and Kraken (8.3) are the most open exchanges, Kalshi (7.3) the most open prediction market and Uniswap (8.0) the most open DeFi platform.
The score rates how fully a Colorado resident can use each platform, not its fees or safety. It is the US score with Colorado’s own limits applied: access status (4 points), the share of the platform’s products open in the state (3), the licences we hold on file (2) and what our geo-access test saw from a US address (1). No tracked platform cuts back Colorado, so the scores match the US scores. The method is on our methodology page.

Which platforms block or limit Colorado residents?
None of the 11 tracked platforms that serve the US blocks or limits Colorado. We found no Colorado exclusion in any platform’s terms, licence page or help centre.
Other states are cut back: Gate excludes Alaska, Louisiana, New York, North Carolina, Texas, Washington and the US Virgin Islands, and Kraken bars EUR and bank funding in Texas. Colorado appears on neither list. Bitstamp turns away only Hawaii and Nevada in its US app list, and Coinbase excludes only New York from loans and Nevada and Michigan from prediction markets. The two gaps in the licence table, Bitstamp and Gate US, are the only open questions, and we will add a row if either platform states a Colorado exclusion.
Who regulates crypto in Colorado?
The Division of Banking licenses money transmission, the Division of Securities prosecutes crypto investment fraud, the Attorney General weighs in on prediction markets, and the Department of Revenue taxes gains. The General Assembly writes the rules.

- Securities Division. Commissioner Tung Chan sued the INDXcoin sellers on 16 January 2024. On 16 September 2025 a Denver court found securities fraud and entered a $3,339,422.15 judgment; a grand jury separately indicted the sellers on 40 counts on 22 July 2025. On 16 December 2024 the Division warned of a surge in Bitcoin ATM scams, citing over $110 million of reported losses in 2023.
- Banking Division. It enforces the Money Transmission Modernization Act and wrote the December 2025 crypto guidance described above.
- Legislature. The General Assembly passed the kiosk law in 2025. We found no bitcoin reserve bill and no further crypto bill from the 2026 session.
Are prediction markets legal in Colorado?
Not settled. Colorado has legal regulated sports betting but no state agency or court has acted against a prediction market, and the Attorney General has told the CFTC that states hold the authority.
- 30 April 2026. Attorney General Phil Weiser joined 41 attorneys general in a comment to the CFTC arguing that sports event contracts belong to the states and that platforms including Kalshi and Polymarket are unregulated sportsbooks.
- 11 May 2026. KUNC reported that Kalshi is not licensed in Colorado and pays none of the 10% sports betting tax, and that the Division of Gaming would not comment on it beyond saying it is monitoring court cases.
- 2 June 2026. Governor Polis signed SB26-131, which limits deposits, bars credit card funding and restricts advertising to people under 21 for licensed sportsbooks. KUNC reported before passage that its protections would not apply to Kalshi.
Without a state order, Kalshi and Polymarket US keep their US status in Colorado. States that have acted, and the court split over event contracts, are covered in our United States guide.
How is crypto taxed in Colorado?
Colorado taxes income at a flat 4.4% for tax year 2025, with no separate rate for capital gains, so a crypto gain is taxed at that rate on top of federal tax. The state also accepts crypto for tax payments.
The Department of Revenue’s income tax guide lists 4.4% for 2025 and 4.25% for 2024, when a TABOR revenue cap cut the rate. We found no Department guidance specific to crypto gains or to sales tax on crypto, and no local income tax. Federal capital gains rules are in our United States guide.
Since 1 September 2022 the Department accepts crypto for income, sales, withholding and other state taxes through the PayPal Cryptocurrencies Hub. The coin is converted to dollars, the fee is $1.00 plus 1.83%, and refunds are never paid in crypto.
